Money Tree Music’s Terms of Use

Documentation:

Your receipt emailed to you after your purchase, along with our transaction records serve as proof of this license acquisition, as well, serve as timestamps for the date that the license was acquired. The name listed as the purchaser in those records is considered the Licensee.

Authenticity:

If this copy of the agreement does not include the official “stamp of approval” Money Tree Music beats watermark in the background, then this agreement is invalid and grants you no right to use any part of the instrumental.

Royalties:

Royalties will be assessed on a case by case basis.

Copyright:

Licensor maintains copyright ownership (PA and SR) of Instrumental Licensor and Licensee are jointly entitled to ownership of copyright of song.  PA and SR ownership are negotiable.

Sampling: 

MTM utilizes both original composition and sampling to provide the highest quality product to our clients.  It is the Licensee’s responsibility to clear the sample for commercial use. 

Exclusive Rights:

Exclusive rights allow the Licensee to use the Instrumental for unlimited commercial recordings or broadcasts.  The Licensor has full rights to record, alter, and mix the instrumental in any shape, way, form (except reselling the Instrumental).  The Licensee must give full credit to the Licensor as on all commercial recordings.  Upon purchasing an exclusive rights, the Licensor still owns the copyright (PA and SR but is no longer able to sell the Instrumental.

1. The Licensor expressly forbids resale or other distribution of the Instrumental. The Licensor cannot sell, loan, rent, lease, assign, any melodies, instruments, drum programming or transfer rights under to another user (example – Record Label, another production company, another producer), or for use in any competitive product without written consent and or another license agreement.
2. If the Instrumental includes samples, the Licensee understands that the sequence and music arrangement is considered original work. Samples may not be cleared before composition, and Licensee is required to seek clearance for the samples. The Licensee is responsible for clearing all samples used (if any) and the Licensor cannot and will not be held liable for the misuse of any sampled material that the Licensee uses in conjunction with the composition/arrangement that is being licensed in this agreement.
3. Licensee must supply the Licensor with at least 1 copy of each final recording made using the Instrumental.
4. Licensee must include credits to Licensor on all physical media containing a portion or sum of the Instrumental that is being licensed in this agreement. Including but not limited to CD’s, CD covers, Cassette tapes, Cards, Mixtapes, Websites, etc. “Produced by Fivestar Beats” will suffice.

Term: 

All rights and terms in this agreement last for 1 (one) year after the acquisition date of this license.  This license will no longer be valid after one year of its purchase date, and will have to be renewed if the Licensee wishes to maintain these rights.  If the Instrumental has been purchased exclusively, it will not be available for license renewal.  Should the Instrumental be purchased exclusively during the terms of the non-exclusive agreement, Licensee will still maintain all rights listed in this agreement, up to one year after the acquisition.

Credit:

In all projects in which the instrumental is used, Licensee shall properly give credit to Licensor as the creator of the instrumental in the song title or artist credit one of the following, or similar formats.

“Production by Aktion Jakson”

“Produced by A-Jaks”

Work with Money Tree Music affiliated artists must also be properly be reference same as above.

Delivery:

All exclusive and nonexclusive products are delivered via email.  Please allow 24 hours for delivery and confirmation of licensing agreement.  Custom serves may be delivered via FEDEX, UPS, or USPS.

Custom Services:

Custom services such as “Mixing”, “Mastering”, “Instrumental Creation”, “Consulting”, “Songwriting”, or any service provided by Money Tree Music, shall be paid in full before services are rendered.

Completed services may be mailed to buyer on a flash drive, and must be signed for by the buyer.  Only “Tagged” copies of work will be emailed to buyer for audit purposes only.

Refund Policy:

If you are not satisfied with any non-exclusive purchase, you may be entitled to a full refund, if Licensee can provide a valid business reason for a refund.  In this case, you will forfeit all rights to the corresponding instrumentals.  A refund in our Paypal record will constitute revoking of your rights to the corresponding products refunded.

This policy does not apply to any custom production or exclusive license.

Reservations:

We do not allow reservation of exclusive or non-exclusive rights to any of our products unless otherwise specified.

Payments:

Money Tree Music accepts PayPal and money orders.  Payment plans for purchases over $1,000 may be negotiable.

Your acceptance of these terms:

By using this site, you signify your acceptance of this policy and terms of service.  If you do not agree with this policy, do not use our site.  Your continued use of the site following the posting of changes to this policy will be deemed your acceptance of those changes.

Privacy Policy

Refusal of Service:

Money Tree Music reserves the right to refuse service to any individual due to current workload.

Sharing your Personal Information:

We do not sell, trade, or rent user’s personal identification information to others.  We may use third party service providers to help us operate our business and the Site or Site administrator activities on our behalf, such as sending our newsletters or surveys.  We may share your information with these third parties for those limited purposes.

Protecting your Information:

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction or your personal information, transaction information, and data stored on our site.  Sensitive and private data exchanged between the Site and its Users happens over SSL secured communication channel and its encrypted and protected digital signatures.

Changes to this Privacy Policy:

Money Tree Music, LLC has the discretion to update this privacy policy at any time.  When we do, we will revise the updated date at the bottom of this page.  We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the limited personal information we collect.  You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of it’s modifications.
